The Frantoio, Tuscany
  1. Definitions
  • "Company" refers to Solusa Limited t/a The Frantoio, a company registered in England with company number 03459136 and having its registered office at 19 Redan Street, London, W14 0AB
  • "Villa" refers to the self-catering villa known as The Frantoio located at The Frantoio, Via Di Tiglio 796, Lucca 55062, Italy.
  • "Guest" refers to the person(s) named in the Booking Confirmation who will be occupying the Villa.
  • "Booking" refers to the reservation of the Villa by the Guest.
  • "Booking Confirmation" refers to the written confirmation issued by the Company to the Guest confirming the Booking.
  • "Rental Period" refers to the dates for which the Villa has been booked, as specified in the Booking Confirmation.
  • "Rental Fee" refers to the total amount payable by the Guest for the rental of the Villa, as specified in the Booking Confirmation.
  • "Security Deposit" refers to the refundable amount payable by the Guest as security against damage or breach of these Terms and Conditions.
  • "Inventory" refers to the list of contents and condition of the Villa provided to the Guest.
  1. Booking and Payment
  • 2.1. A Booking request can be made via the Company’s website, email, or telephone.
  • 2.2. All Bookings are subject to availability and acceptance by the Company.
  • 2.3. A Booking is only confirmed when the Company issues a Booking Confirmation after receiving the required deposit.
  • 2.4. A deposit of 30% of the Rental Fee is payable upon Booking. 
  • 2.5. The remaining balance of the Rental Fee, along with the Security Deposit of €1,500 is due 6 weeks prior to the commencement of the Rental Period.
  • 2.6. Payments can be made by credit card, debit card or bank transfer.
  • 2.7. If the balance is not received by the due date, the Company reserves the right to cancel the Booking and retain the deposit.  
  • 2.8. All prices are inclusive of tax, utilities (excluding excessive use), linen, towels, final cleaning.
  1. Security Deposit
  • 3.1. The Security Deposit is held by the Company as security for any damage to the Villa or its contents, excessive utility usage, or breach of these Terms and Conditions.
  • 3.2. The Security Deposit will be refunded to the Guest within 10 days after the end of the Rental Period, subject to a satisfactory inspection of the Villa and deduction of any costs for damage, loss, or excessive usage.
  • 3.3. The Company reserves the right to deduct from the Security Deposit any reasonable costs incurred due to the Guest’s breach of these Terms and Conditions. If these costs exceed the Security Deposit, the Guest will be liable for the outstanding balance.
  1. Arrival and Departure
  • 4.1. The Villa will be available for check-in from 4pm on the first day of the Rental Period.
  • 4.2. The Guest must vacate the Villa by 10am on the last day of the Rental Period.
  • 4.3. Late check-out may be possible subject to availability and prior arrangement with the Company, and may incur an additional charge.
  • 4.4. Key collection and return arrangements will be communicated to the Guest prior to arrival.
  1. Occupancy and Use of the Villa
  • 5.1. The number of guests occupying the Villa must not exceed the maximum occupancy stated in the Villa description and Booking Confirmation. The Company reserves the right to refuse entry or terminate the Booking without refund if this condition is breached.
  • 5.2. The Villa is to be used for holiday accommodation purposes only and not for any commercial or illegal activities.
  • 5.3. Guests are expected to respect the local community and avoid excessive noise, particularly during night hours.
  • 5.4. Small pets are allowed at the Villa. This must be agreed upon at the time of Booking and will be subject to additional charges.
  • 5.5. Smoking is not allowed inside the Villa. If allowed, it may be restricted to designated outdoor areas.
  • 5.6. Guests are responsible for maintaining the cleanliness of the Villa during their stay and leaving it in a reasonably clean and tidy condition upon departure.
  • 5.7. Guests must comply with any specific rules and regulations provided by the Company or displayed at the Villa.
  1. Care of the Villa and Property
  • 6.1. Guests are responsible for taking reasonable care of the Villa and its contents.
  • 6.2. Any damage or loss to the Villa or its contents caused by the Guest or their party must be reported to the Company as soon as possible.
  • 6.3. The Company reserves the right to charge the Guest for the repair or replacement of any damaged or lost items.
  • 6.4. Guests should ensure that all doors and windows are securely locked when leaving the Villa unattended.
  • 6.5. Guests are responsible for the safe use of all appliances and facilities at the Villa.
  1. Utilities
  • 7.1. Unless otherwise specified in the Booking Confirmation, reasonable usage of utilities (electricity, gas, water) is included in the Rental Fee.
  • 7.2. The Company reserves the right to charge for excessive or unreasonable consumption of utilities.
  1. Changes and Cancellations by the Guest
  • 8.1. Any request for changes to a Booking must be submitted in writing and is subject to availability and the Company’s approval. An administration fee may apply.
  • 8.2. If the Guest cancels a Booking, the following cancellation charges will apply:
    • If the Booking is cancelled 6 weeks prior to the Rental Period commencement, the 30% deposit taken at the time of booking will be refundable. 
    • If the Booking is cancelled on the date of 6 weeks prior to the Rental Period commencement, the 30% deposit will be non-refundable.
    • If the Booking is cancelled within 6 weeks of Rental Period commencement, 100% of the Rental Fee will be non-refundable.
  • 8.3. The Company recommends that Guests take out appropriate travel insurance to cover the risk of cancellation.
  1. Changes and Cancellations by the Company
  • 9.1. In the unlikely event that the Company needs to make a significant change to the Booking (e.g., significant alteration to dates), the Company will inform the Guest as soon as reasonably practicable and offer the Guest the option of:
    • Accepting the changed arrangements.
    • Booking an alternative villa of comparable standard (if available), with any price difference being refunded or paid by the Guest as applicable.
    • Cancelling the Booking and receiving a full refund of all monies paid.
  • 9.2. The Company reserves the right to cancel the Booking in exceptional circumstances beyond its reasonable control (force majeure), such as fire, flood, natural disaster, or other unforeseen events that make the Villa uninhabitable. In such cases, the Company will refund all monies paid by the Guest.
  • 9.3. The Company shall not be liable for any consequential losses or expenses incurred by the Guest as a result of any changes or cancellations.
  1. Access
  • 10.1. The Company or its authorized representatives may require access to the Villa at reasonable times for essential maintenance, repairs, or inspections, with prior notice to the Guest, except in cases of emergency.
  1. Liability
  • 11.1. To the maximum extent permitted by law, the Company shall not be liable for any personal injury, loss, or damage to the Guest’s or their party’s belongings during their stay at the Villa.
  • 11.2. Guests are responsible for ensuring they have adequate travel insurance to cover personal injury, illness, loss of belongings, and cancellation.
  • 11.3. The Company shall not be liable for any events outside its reasonable control, including but not limited to power cuts, water shortages, internet outages, or noise from neighbouring properties.
  1. Complaints
  • 12.1. Any complaints regarding the Villa should be reported to the Company or its local representative as soon as possible during the Rental Period to allow for remedial action to be taken.
  • 12.2. Complaints not reported during the Rental Period may be difficult to investigate and may not be considered.
  • 12.3. If the Guest is not satisfied with the resolution offered, they should submit a written complaint to the Company within 14 days of the end of the Rental Period.
  1. Governing Law and Jurisdiction
  • 13.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.  
  • 13.2. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions. 
  1. Data Protection
  • 14.1. The Company will process the Guest’s personal data in accordance with its Privacy Policy, which is available on the Company’s website.
  1. Entire Agreement
  • 15.1. These Terms and Conditions, together with the Booking Confirmation, constitute the entire agreement between the Company and the Guest relating to the rental of the Villa and supersede all prior discussions, agreements, or understandings.
  1. Severability
  • 16.1. If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
